Please read these Terms & Conditions (“Terms”) carefully before using our website https://sobe-luxury-travel.webflow.io (the “Site”) and/or engaging our travel services (the “Services”). By accessing or using the Site or by booking or otherwise using any Services, you agree to these Terms.

1. Introduction
1.1   These Terms govern the relationship between you (“you”, “Client”, “Traveller”) and SoBe Luxury Travel (“we”, “us”, “our”).
1.2   We provide luxury travel planning, vacation packages, destination services and related travel-arrangements as described on our Site.
1.3   By booking a trip or using the Site, you confirm that you are at least 18 years of age, have full legal capacity, and have authority to enter into these Terms.
1.4   If you book on behalf of other travellers, you warrant that you have informed them of these Terms and take full responsibility for their compliance.

2. Bookings, Quotes & Payments
2.1   When you request a travel package or itinerary, we will provide a quote including pricing, scope of services, payment terms, and deadlines.
2.2   A binding booking occurs only once we receive your accepted quote, any required deposit/payment, and written confirmation from us.
2.3   Final payment is due by the date specified in your booking documentation. Failure to pay on time may result in automatic cancellation and forfeiture of any deposit.
2.4   All payments must be made in the currency specified, via the payment method we accept. You are responsible for any bank fees, currency conversion or transaction costs.

3. Services & Third-Party Suppliers
3.1   We act as your agent in arranging travel services (such as flights, hotels, transfers, excursions) through third-party suppliers (“Suppliers”).  We do not own or operate these Suppliers and cannot control their performance.
3.2   Accordingly, we are not liable for the acts, omissions, bankruptcy, safety standards, or failure of any Supplier. You acknowledge that booking any Supplier service is subject to that Supplier’s terms and conditions. [In line with typical industry practice.
3.3   You agree to comply with all Supplier rules and instructions (including visas, passports, health/entry requirements, etc.). We strongly recommend that you obtain appropriate travel insurance.
3.4   We reserve the right to refuse or cancel bookings at our discretion (e.g., if a Supplier cannot confirm, due to pricing error, or health/safety concerns).

4. Changes, Cancellations & Refunds
4.1   Any changes to bookings after deposit must be requested in writing and are subject to availability, Supplier acceptance, and any applicable change fees.
4.2   If you cancel a booking, cancellation fees apply as detailed in your booking documentation and also as governed by Suppliers’ own policies.
4.3   Refunds are processed according to Supplier policies. We shall act on your behalf but cannot guarantee refund amounts or timing.
4.4   If we cancel a booking due to Supplier default, we will attempt to secure alternatives or issue a refund, but we are not liable for any further compensation.

5. Pricing & Errors
5.1   Prices shown are based on current Supplier rates, currency exchange rates, availability, and other factors as at quote date. They may change until paid in full.
5.2   We reserve the right to correct any errors, omissions or inaccuracies, including after a booking has been confirmed. In such event you may choose to cancel or accept revised pricing.
5.3   We do not guarantee that the fare or price you book is the lowest possible – travel pricing is dynamic.

6. Your Responsibilities
6.1   You must provide correct, complete, and timely information (names matching passports, contact details, etc.). Errors or omissions may result in additional charges or cancellation.
6.2   You are responsible for obtaining and carrying valid passports, visas, travel documents, health certificates and compliance with destination entry/exit requirements.
6.3   You must adhere to all laws and regulations of destinations and Suppliers. We will not be liable if your behaviour leads to cancellation or difficulties.
6.4   You should check your travel documents, itineraries and vouchers when received and notify us immediately of any inaccuracies.

7. Limitation of Liability
7.1   To the fullest extent permitted by law, our liability to you for any loss, damage, cost or expense arising from our provision of the Services or the supply of the booking is limited to the amount you paid for the booking.
7.2   We are not liable for any special, indirect, incidental or consequential damages, including loss of enjoyment, even if we have been advised of such possibility.
7.3   We are not liable for:
a) any act or omission of any third-party Supplier;
b) any event or circumstance beyond our reasonable control (force majeure) such as natural disasters, pandemics, war, terrorism, civil unrest, government action, weather, etc.
c) you missing or mis-using a service, flight or connection if you fail to follow Supplier instructions or schedules.

8. Intellectual Property
8.1   All content on the Site (text, images, graphics, trademarks, logos) is our property or used under licence. No part may be reproduced, modified or distributed without our prior written consent.
8.2   You may view and print pages for your personal use only, provided you keep all copyright and proprietary notices intact.

9. Privacy & Data Protection
9.1   Our Privacy Policy (see below) explains how we collect, use and protect your personal data. By using the Site and booking our Services you agree to it.
9.2   You consent to us sharing your personal data with Suppliers, payment processors, travel insurers and other necessary third parties to facilitate your travel arrangements.

10. Jurisdiction, Governing Law & Dispute Resolution
10.1   These Terms are governed by the laws of [Insert State/Country] without regard to its conflict of law provisions.
10.2   You and we agree to submit to the exclusive jurisdiction of the courts of [Insert Location] for any dispute arising out of or in connection with these Terms.
